The growing significance to employers of sound legal advice in relation to the provision of pension and other employee benefits cannot be overstated. Employers will recognise the importance and benefits of employee incentives in recruiting and motivating their workforce. Equally, employers have to ensure that these incentives, particularly pensions, are rooted in commercial reality.
We advise employers and pension scheme trustees on the complex area of pensions legislation and the raft of related rules and regulations.
In addition to pensions advice, we have in depth resources to tackle other employee incentive arrangements including employee share schemes. The Government is keen to promote employee share schemes and two new schemes, the Enterprise Management Incentive Scheme (EMI) and the Share Incentive Plan Share Incentive Plan (SIP) were introduced under the Finance Act 2000. Both schemes can confer significant tax benefits and are becoming increasingly popular with a range of employers.
In addition to the EMI and SIP schemes, there are a variety of other share schemes, some of which require approval by the Inland Revenue in order to confer tax benefits on the recipient of the shares, while others are of a more informal nature.
